Spain tax residence calculator (183-day rule)
Spain treats you as tax resident if you spend more than 183 days in Spanish territory during the calendar year. The days do not need to be consecutive and, unless you can prove tax residence in another country, sporadic absences are added back as if you had never left.
That last rule is what catches people who split the year between several countries: counting nights in Spain is not enough, you must be able to show where you were the rest of the time. It is why advisers ask for passport stamps, boarding passes and hotel invoices, and why the record should be kept up to date.
Beyond physical presence, the law also looks at the main centre of economic interests and at where the spouse and minor children live. This calculator covers the days only; the rest needs professional analysis.

Frequently asked questions
- Do the arrival and departure days count as days in Spain?
- Administrative practice counts any day on which you were in Spanish territory, even for a few hours. The calculator applies that criterion, which is the most prudent one.
- What are sporadic absences?
- Temporary trips out of Spain that the tax agency may treat as presence if you cannot prove tax residence in another country with a certificate. A two-week trip to Lisbon does not reduce the count without that certificate.
- Can I be resident with fewer than 183 days?
- Yes. If the main centre of your activities or economic interests is in Spain, or if your non-separated spouse and minor children habitually live there, residence is presumed even below 183 days.
